Steps to Follow After Receiving Legal Notice from a Lawyer

Nowadays Litigation has become very common and more and more people are choosing to take their matters to court who were earlier reluctant in filing their cases. With that Sending of Legal Notices has also become very common as few of the Legislation makes it mandatory to serve a Legal Notice prior of filing of the case like Transfer of Property Act, Indian Contract Act, Negotiable Instruments Act etc.

Legal Notice Meaning & Objective –

Meaning – Notice means Intimation. Not only it should be writing but the intent of it should also be clear. It should be explanatory enough to suggest that the party is interested in the filing of the case if their demands are not adhered to.

Objective – The Objective of the Notice is to make it clear to the other party the intention to approach the court to settle the dispute is it is not already settled/

Following are the cases in which the Legal Notice is commonly sent –

  1. Property Dispute
  2. Dishonor of Cheque
  3. Family Dispute
  4. Consumer Disputes
  5. Labor Matters

Also, the Law states that if a Legal Action is to be taken against a public officer/servant then he should be intimated by a notice and should be given a time of 2 months to rectify his behavior. 

Steps to be followed once you receive the Legal Notice –

Do not panic, Once you receive the notice you would be required to send the reply in stipulated time. If you don’t give the reply to the Notice then it would go against you in the case.

1st Step: Read the contents of the Notice carefully and see if they are true or False.

2nd Step: Check the Time period within which the Notice has to be replied.

3rd Step: Approach a good lawyer who can frame the reply of the Notice

Legal Notice is an important aspect of litigation and the reply should be very well drafted. Anything wrong that is stated in the reply of the Notice can go against you in the case
