How Can Consumer File Complaint against an E-Commerce Portal?

With the Ever Increasing expansion of the Internet, The Number of users of E-Commerce Platforms like Flipkart, Amazon, ShopClues etc is Increasing. These Platforms have surely helped a lot of Consumers in getting their products at their Doorstep but with that, there are also few consumers who have their grievances which are not being addressed properly and they would want to take those grievances to the Court.

The Consumer Protection Act is the Legislation which was enacted to protect the rights of consumers against the Sellers of Goods or Providers of Services which were not taking the right measures to resolve the grievances of the Consumers. With this act, a lot of this changed and now the Consumer is the King.

Consumer Redressal Forum, Commonly known as consumer courts have been set up at the district level to adjudicate on the matters pertaining to Consumer Disputes.

Redressal Mechanism

The First step for every customer who is facing any problem or is dissatisfied is that he should contact the customer care department by following ways –

  1. Contact the Customer Care unit by phone/e-mail.
  2. Posting your grievance on social media platforms like Twitter, Facebook etc.

Consumer Redressal Forum Faridabad

The Consumer Forum or the Consumer Court can be approached when the consumer’s grievance is not resolved by the Brand. But it is important to note that the Consumer has to consider the regional and financial jurisdiction of the forum before filing the complaint. For that, a Lawyer in Faridabad can help out.

  • District forum of Faridabad can be approached when the dispute does not exceed rupees twenty lakhs.
  • State Commissions in Chandigarh is to be approached if the Matter is between 20 Lakh and 1 Crore.

The Complaint can be registered in a forum where –

  • The Respondents of the complaint reside or works for gain
  • Where the cause of dispute/Action arose

The procedure for the same has been listed below-

  1. A limitation with respect to Time – The case has to be filed within 2 years of the cause of action. It is suggested then the case should be filed as early as possible as the delay makes the case weaker.
  2. The Consumer should have the proofs of the Purchase such as Invoice, Email or any other relevant document.
  3. The Complainant should pay the fees in form of Demand Draft or Postal Order. The Prescribed fee for making complaints in a District Forum is
    For maters upto1 Lakh- Rs. 100
    For Matters Above 1 Lakh but less than  5 Lakhs –Rs. 200
    For Matters Above 5 Lakhs but less than 10 Lakhs- Rs. 400
  4. In the last paragraph of the complaint, the relief is sort in form of prayer.
  5. The Complainant or his Lawyer/Advocate can present the complaint.

After the complaint is filed the President at the Consumer Court will issue summons to the other party is he is convinced that a legitimate case is there. After that, the case will continue and the decision would be announced on the merits of the case.
