Compulsory Registration of NRI marriages within 7 Days

NRI marriage would simply mean marriage between Indian and an Indian which is presently residing in some other country or is a Non-Resident Indian(NRI) which could mean that either he is a citizen of India or he could be a citizen of other country or is a Person of Indian Origin(PIO).

Women in such marriages are at increased risk of Dissertation and being left by the husband. Also, the women are unaware of the Local laws and may have communication problems because of which they face issues like assault, cruelty abandonment etc.

In order to provide relief, Ministry or Women and Child on 14th June declared that all NRI marriage need to be compulsorily registered. If the parties do not comply with this provision then it would directly affect their VISA and Passport clearances.

Code of Criminal Procedure, Passport Act and Marriage Act will be amended with multi-fold consequences so as to ensure that this law is implemented. To get help with that you surely need a lawyer in Delhi NCR.

This would be beneficial for the welfare of the wife as now her legal rights will be enforceable in law, the husband won’t be permitted to flee without a legal stamp of marriage and the wife won’t be leaving the home country without an assurance or security from the husband’s side and the law as well. By this, the Cases of Bigamy would also be prevented.

Registration Process of NRI Marriages

If both the parties to the marriage are Hindu then Hindu Marriage Act is applicable, but if either of the Party belongs to some other religion then Special Marriage Act is applicable.

The Marriage between an NRI and Indian Citizen can be registered through the following process –

  1. Notice for Marriage is Filed by a Family Lawyer.
  2. Publication of Notice is done by the registrar to invite objections against the marriage.
  3. Objections are Received and Inquiry is conducted accordingly.
  4. Marriage declaration is signed if no enquiry is received.
  5. Marriage Certificate is granted by the Registrar.
